# Harley-Davidson is Suing Affliction Over Some Very Familiar Looking Imagery

Few logos are more recognizable than the Harley-Davidson bar and shield logo. This iconic logo has been worn on [Harley motorcycles](<https://www.thedrive.com/article/13728/harley-davidson-unveils-2018-softail-lineup-ditches-dyna-models>) in some form or another since 1910. The version we know today was introduced way back in 1965 and has graced not only motorcycles, but countless pieces of merchandise and apparel like helmets, t-shirts, boots, bandanas, and [just about anything that can be worn](<https://www.thedrive.com/article/15324/harley-davidson-celebrates-115th-anniversary-with-insulating-clothing>), hung on a wall or displayed on a desk. This is clear if you’ve ever been in a Harley-Davidson dealership. Some of them seem like Harley gift shops that also sell motorcycles.

Harley-Davidson understandably takes its logo very seriously. That’s why when it’s allegedly being copied, Harley isn’t happy. “The Harley-Davidson brand is one of our company’s most important assets,” said Harley-Davidson manager of corporate media relations Michael Pflughoeft in an email to *The Drive*. “We take great pride in the quality of the products that carry our trademarks, and we are legally required to exercise control over the use of our trademarks.”

The latest brand to be accused of ripping off the Harley logo is Affliction. Very familiar looking bar and shield images with prominent use of the word "motor" have been appearing on the brand’s apparel. So familiar, in fact, that [Harley-Davidson has filed suit](<https://www.thedrive.com/article/11345/remember-when-harley-davidson-sued-honda-for-being-too-harley>) in the U.S. District Court for Eastern Wisconsin against Affliction for copyright infringement according to Milwaukee business news outlet [*BizTimes*](<https://www.biztimes.com/2017/industries/law/harley-davidson-doesnt-want-brand-confused-with-affliction-products/>). It began with a cease and desist letter sent from Harley on Oct. 18 alleging that Affliction is selling 20 products bearing a shield logo that infringed on [Harley’s trademark](<https://www.thedrive.com/article/16986/harley-davidson-just-trademarked-the-name-bronx>). Affliction’s response was ending sales of six of the 20 products named in the complaint.

Since 14 of these products are still on sale, Harley is taking further action. “We make every effort to ensure consumers are not confused by the source of merchandise bearing our trademarks,” said Pflughoeft. “By altering and reproducing the Harley-Davidson logo for use on clothing, we believe Affliction has violated our trademark, and this violation could cause confusion among customers that Affliction is somehow affiliated with or endorsed by Harley-Davidson.”

In other words, it’s a big problem for Harley because by allegedly using the brand’s (highly recognizable) logo, it’s like Affliction is taking money out of Harley’s pocket. “By actively protecting our trademarks and patents, we also protect our dealers, licensees, shareholders and other stakeholders who are invested in our brand,” said Pflughoeft.
